Court grants suspensive effect to Lisa and BDT appeals against standing and accounting denial

By this edict of April 7, 2025, the 16th Circuit Civil Court of the First Judicial Circuit of Panama granted suspensive effect to the appeals announced by Lisa, S.A. and BDT Investments, Inc. against Judgment No. 71 of January 31, 2025. The grant of suspensive effect stayed all enforcement of the challenged judgment while the appellate court considers the merits of both appeals, preserving the procedural statu quo until the First Superior Tribunal of Justice issues its ruling.
Judgment No. 71 had declared ex officio the lack of active standing of Lisa, S.A. and the lack of passive standing of Juan Luis Bosch Gutierrez, denying the accounting claim and rejecting BDT Investments, Inc.'s request to intervene as litisconsorte. The judgment also ordered Lisa to pay $40,000.00 in costs to the defendant. Both Lisa, through Lcda. María L. Villarreal, and BDT, through Lcdo. Carlos de Icaza Muñoz, challenged the judgment in its entirety. Lisa's appeal and BDT's appeal were both granted for appellate review.
The suspensive effect meant that the standing determinations, the denial of the accounting claim, and the cost award remained unenforceable pending appellate resolution. The case file was transmitted to the First Superior Tribunal, which subsequently issued the ruling of July 9, 2025, modifying the judgment only to exonerate Lisa from the cost award while upholding the remainder of the decision.
