Procedural Context

BDT's application came at an advanced stage of the summary accounting proceeding (<law id="pty-83573-21" />). After multiple attempts at international service of process in Guatemala, publication of edicts, and Bosch's failure to appear, the court appointed an absent-defendant attorney on August 9, 2024 (<doc id="pty-83573-21-2024-08-09-a" />). BDT's intervention as assignee of Lisa's litigation rights sought to ensure representation of the substantive interest in the accounting for more than $44.9 million in dividends retained under judicial deposit since 2008.

Ruling

• BDT Investment Inc. was admitted as an interested third party (litisconsorte) in the accounting proceeding brought by Lisa, S.A. against Juan Luis Bosch Gutiérrez
