Through this order, the First Civil Circuit Court of the First Judicial Circuit of Panama directs service by edict upon Villamorey, S.A. (legally represented by Ramiro López Nimatuj) and Juan Luis Bosch Gutierrez personally, in the ordinary damages proceeding brought by Lisa, S.A. The order addresses the failure to accomplish personal service of the Order 2966/EJE-8853-24 of April 12, 2024, which admitted the complaint, and the Order No. 1217/EJE-8853-24 of May 8, 2024, which amended it to add Bosch as a personal defendant.

Procedural Background

The service report of July 16, 2024 documented two unsuccessful visits to the offices of Galindo, Arias & López, Villamorey's resident agent, located at Avenida Federico Boyd, Scotia Plaza, Floor 11, Office 11. On both occasions (July 10 and July 16, 2024), Lcda. Maricel Oballes, a member of the firm's staff, stated that she did not know the individuals sought. The inability to locate the defendants at the address of their own resident agent triggered the subsidiary notification mechanism under Article 1017 of the Judicial Code.

Ruling

  • Service by edict is ordered for Villamorey, S.A. and Juan Luis Bosch Gutierrez pursuant to Article 1017 of the Judicial Code.

Legal Basis

  • Article 1017 of the Panamanian Judicial Code — Authorizes service by edict when personal notification has proven impossible and the defendant's whereabouts are unknown.

Signatories

  • Marietta Abrego Santos, Judge
