This order corrects a procedural omission in the admission of the ordinary damages action filed by Lisa, S.A. against Villamorey, S.A. and Juan Luis Bosch Gutiérrez. The Order No. 966/EJE-8853-24 of April 12, 2024, which admitted the claim, named only Villamorey as defendant, even though the complaint was filed against Bosch personally as well. Attorney María Luisa Villarreal Palacios, acting on behalf of Lisa, requested the correction.

Addition of Defendant

The Court relied on Article 999 of the Judicial Code, which authorizes a judge to amend rulings at any time. Through this addition, Juan Luis Bosch Gutiérrez, identified as a Guatemalan male bearing identity document No. A-1 424075, was formally included as a personal defendant. The Court granted him ten days to answer the complaint, leaving all other provisions of the original order unchanged.

Ruling

  • The Order No. 966/EJE-8853-24 is amended to include Juan Luis Bosch Gutiérrez as a personal defendant
  • Bosch is granted ten days to answer the complaint
  • All other provisions of the original order remain in effect

Legal Basis

  • Article 999 of the Judicial Code — Authorizes the court to correct and amend its rulings at any time
