Summons Villamorey, S.A. to appear for notification under warning of edict service

On July 9, 2024, the First Civil Circuit Court of the First Judicial Circuit of Panama issued an official notice to Ramiro López Nimatuj, legal representative of Villamorey, S.A., informing him of the ordinary damages action filed by Lisa, S.A. in Case File No. 8853-24. The notice is a formal procedural step preceding service by edict, triggered by the court's inability to achieve personal notification of the defendant.
The court records that a judicial notifier from the Judiciary appeared at the offices of the defendant company to effect service of process but was unable to do so. This failed attempt triggered the procedure under Article 1017 of the Judicial Code, which authorizes the court to summon the legal representative directly before resorting to service by edict.
Lisa's damages claim had been admitted by Order No. 966/EJE-8853-24 of April 12, 2024, and the court subsequently added Juan Luis Bosch Gutiérrez as a personal defendant on May 8, 2024. By the date of this notice, nearly three months had elapsed without either defendant being personally served.
The court grants Villamorey, S.A. a three-day period to appear at the court and receive formal notification of the order transferring the lawsuit. The warning is explicit: if the defendant company fails to appear within the allotted time, it will be served by edict at its own expense. Villamorey did not appear within the granted period, leading to the service report of July 16, 2024 documenting further failed attempts, and ultimately to the order of September 16, 2024 directing service by edict.
