12th Civil Court
Through Official Notice No. 29 dated January 3, 2025, the Twelfth Civil Court of the First Judicial Circuit of Panama formally notified the Eleventh Civil Court that the 2012 attachment over Lisa, S.A.'s rights in Ordinary Proceeding No. 556-99 has been lifted. This communication executes the directive of the Fourth Superior Tribunal's confirmatory ruling of September 30, 2024, which upheld Order No. 898 of April 12, 2022, approving the settlement between BDT Investments Inc. and Lisa, S.A. and ordering the lifting of the attachment.
The attachment had been imposed through Order No. 1838 of December 12, 2012 and covered any sums, rights, or credits in favor of Lisa, S.A. within the ordinary proceeding with sequestration action brought by Lisa, S.A. against Villamorey, S.A. before the Eleventh Court (Case No. 556-99, Sequestration Action No. 7081-08), up to $19,184,680.00. By directing this notice to the court handling the proceeding against Villamorey, the Twelfth Court ensures that the Eleventh Court updates its records and removes any judicial restriction over Lisa's rights in that case file.
This notice is one of three official communications issued on the same date. Notice No. 28 notified Villamorey, S.A. directly of the lifted attachment over the funds it was required to deliver to Lisa, S.A. from GTC Bank accounts. Notice No. 30 informed local banks of the lifted attachment over Lisa's bank accounts. Together, these three communications cover the three axes of the original 2012 attachment: funds held by Villamorey, Lisa's litigation rights before the Eleventh Court, and Lisa's bank accounts.
The notice expressly references Notice No. 55 of January 14, 2013, which was the original communication notifying the Eleventh Court of the 2012 attachment. This reference establishes procedural continuity and allows the receiving court to link both communications in its case file.
