Background

Lisa, S.A. reported to the Prosecutor's Office that it initiated an enforcement proceeding against Villamorey, S.A. before the Eleventh Circuit Civil Court, Exp. 117030-21, in which the court issued Order 2567 on December 22, 2021, admitting the executive complaint. Villamorey, S.A. appealed that order, and the appeal was granted with devolutive effect. Under Panamanian procedural law, an appeal with devolutive effect does not stay the main proceeding. According to Lisa, S.A., the judge nonetheless refused without justification to act on party requests, thereby paralyzing the enforcement proceeding.
