Under the settlement signed in 2020 and approved by a Panamanian court in 2022, Lisa assigned its litigation rights against the Avícola Villalobos Group to BDT Investments Inc., its creditor. In early 2024 BDT asked to join the suits pending against Lisa as a tercero coadyuvante, a supporting party that stands beside the defendant. Three courts admitted it in six suits in March 2024; two others refused, one because judgment had already been given. The companies object that the settlement does not name them, that BDT seeks in substance to replace Lisa, and that the Panamanian order needs recognition in Guatemala; the courts have so far reserved those objections to the final judgment, and an amparo against one admission was denied in January 2025. Three companies have also sued the notary who recorded the settlement in Guatemala; one suit has failed and two are pending.
